Do Blended Families Need A Will?

If you know someone who is a spouse in a blended family (second marriage with kids from other relationships) and does not have a will —- please, please encourage them to get one.

Many states (including Texas) have unforeseen consequences for disposition of property in the event of the death of a spouse.  For example, if a spouse dies in Texas and has children outside the marriage, then barring a will to the contrary, those children inherit the deceased spouse’s interest in Community Property as well as Separate Property.   Most people have no idea that the house or other property that they have purchased with their spouse could be subject to ownership by their spouse’s children in the event of their spouse’s death. If the spouse dies with any separate property, the result is even more surprising. Avoid surprises at an already traumatic time…. please look into estate planning.
